Authorizing Sale of Vehicle and Ambulance(S) No Longer Needed for Municipal Purposes To the Monmouth Junction First Aid Squad, Inc.

WHEREAS, N.J.S.A. 40A:12-21.1 indicates that, when the governing body of a municipality determines that personal property owned by the municipality is no longer needed for municipal purposes, the governing body by ordinance may authorize a private sale of said property, for a nominal consideration, to any duly incorporated volunteer first aid and rescue squad; and
WHEREAS, the Monmouth Junction First Aid Squad Inc. of South Brunswick Township, is a duly incorporated non-profit and charitable organization, the purpose of which is to provide basic life support ambulance and rescue services to the general public; and
WHEREAS, South Brunswick is therefore authorized to sell personal property no longer needed for municipal purposes, for nominal consideration, to the Monmouth Junction First Aid Squad Inc. of South Brunswick Township, pursuant to the terms and conditions set forth in State statute; and
WHEREAS, the Township holds title to certain vehicle(s) and ambulance(s) that are no longer needed for municipal purposes, which the Township wishes to sell to the Monmouth Junction First Aid Squad Inc. of South Brunswick Township, for nominal consideration;
NOW THEREFORE BE IT ORDAINED by the Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:
It hereby authorizes the sale of the following vehicle and ambulances that are no longer needed for municipal purposes, to the Monmouth Junction First Aid Squad Inc. of South Brunswick Township, for the sum of $1.00:

The Township Manager and Township Clerk shall be and are hereby authorized to execute any and all documents that may be necessary in order to complete the sale.
This sale is contingent upon the Monmouth Junction First Aid Squad Inc. of South Brunswick Township, completing the transfer of the vehicle titles and returning the current license plates to the Township.
This sale is further contingent upon use of said property only for the purposes of the Monmouth Junction First Aid Squad Inc. of South Brunswick Township, and not for commercial business, trade or manufacture. If the property is not used in accordance with this limitation, ownership thereto shall automatically revert to the Township of South Brunswick.
If any clause, sentence, paragraph, section or part of this ordinance or any other codes or ordinances incorporated herein shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof, directly involved in the controversy in which said judgment shall have been rendered.
This ordinance shall become effective twenty (20) days after its final passage.
The above ordinance was introduced and passed on first reading at a regular meeting of the Township Council of the Township of South Brunswick held on October 7, 2026, and will be considered on second and final reading and final passage at a regular meeting of the Township Council of the Township of South Brunswick to be held at the Municipal Building, Monmouth Junction, New Jersey, at 6:00 P.M. on October 21, 2026 at which time and place any person having an interest therein will be given an opportunity to be heard.
